Copyright and Takedown Policy
Version 1.0, effective
How to tell us that content on a screen infringes your rights, and how we respond.
About this policy #
FLOW FN PTE. LTD. (UEN 202617303Z), a company incorporated in Singapore respects the rights of creators. Customers publish their own content to their screens through Nayto, and we do not review it beforehand. If you believe content shown through the Service infringes your copyright, this policy says how to tell us. It follows the notice-and-takedown scheme for network service providers in Singapore's Copyright Act 2021. A notice sent in the form another country's law asks for - the United States DMCA's, for example - is accepted if it gives what is listed below.
Sending a notice #
Write to legal@nayto.io with "Copyright notice" in the subject, in English, including:
- your signature, or an electronic equivalent, as the owner of the copyright or a person authorised to act for them;
- the work you say is infringed;
- the content you say infringes it, and enough to let us find it - where the screen is and when the content played, or the name of the organization showing it;
- your name, postal address, telephone number and email address;
- a statement that you believe in good faith that the use is not authorised by the owner, their agent or the law; and
- a statement that the information in the notice is true and accurate, and that you are the owner or authorised to act for them.
We may not be able to act on a notice that leaves any of these out.
What we do with a notice #
If a notice is complete, we will remove the content or stop it from being shown, and tell the organization that published it, passing on the notice with your contact details unless you ask us not to and the law allows. We may ask you to clarify a notice that is unclear or appears to be made in bad faith.
Counter-notice #
If your content was removed and you believe that was a mistake - because you own the copyright, have a licence, or the use is otherwise allowed by law - write to legal@nayto.io with: your signature, or an electronic equivalent; the content removed and where it appeared; a statement of why you believe in good faith that it was removed by mistake, and that the information in your counter-notice is true and accurate; your name, address, telephone number and email address; and your agreement to the jurisdiction of the courts of Singapore.
We will pass the counter-notice on to the person who sent the notice. If they do not tell us within 10 business days that they have started court proceedings about the content, we may let it be shown again.
Repeat infringement #
We close, in appropriate circumstances, the accounts of organizations that repeatedly infringe.
False notices #
Knowingly making a false statement in a notice or counter-notice can make you liable, under Singapore's Copyright Act 2021, for the loss it causes. Do not send a notice unless you are the owner or authorised to act for them.
Other rights #
For trademark, publicity or other claims that are not about copyright, write to legal@nayto.io with what is affected and evidence of your rights. We will look at each in good faith.
How this document changes #
Every version of this document has a number and the date it applies from, both printed under the title. A change is published as a new version rather than an edit to this one, so what the document said on any day can be checked.
When a change matters to what you have agreed or to how we use your data, we tell you before it takes effect. Earlier versions are available from legal@nayto.io.
